Eligibility criteria for UK Indefinite Leave to Remain Visa

  • To be eligible for the UK ILR Visa, you must have lived in the UK legally for a certain period, depending on your visa category e.g., whether you’re on a work, family, or other visa category, understanding the path to ILR is crucial. For most visa categories, the eligibility period is 5 years. However, there are some exceptions, such as for spouses of British citizens, who may be eligible for ILR after 3 years.

Visa categories that lead to ILR visa after 3 or 5 or longer years of stay

  • Skilled Worker Visa: You may qualify for ILR after 5 years residency in the UK, working for a UK employer who is Home Office approved sponsor, have continuous employment and meeting the income requirements.
  • ILR for Health and Care Worker Visa holder: Eligibility includes 5 years of continuous UK residence, English proficiency, passing the Life in the UK test, and sustained employment in the healthcare sector.
  • Hongkong BN(O) Status Visa Holder: provided you meet all the requirements and have 5 years of continuous stay in UK on this route, you may be able to apply for ILR.
  • Scale-up Worker Visa: after initial 2 years visa, you will be able to extend it for 3 years as many times as you want. After completing 5 years you will be able to apply for ILR subject to you meet the necessary criteria.
  • Global Talent Visa: Individuals who are leaders or potential leaders or exceptional talents in their fields (i.e. science, engineering, humanities, medicine, digital technology, arts, culture) and who have been endorsed by a recognized endorsing body may be eligible to apply for a fast-track settlement or ILR after 3 to 5 years
  • Innovator Founder Visa: If you’ve been on an Innovator Visa as an Entrepreneur and have met the requirements for innovation, business development, and job creation in the UK then you may apply for ILR after 3 years.
  • Tier-1 – Entrepreneur Visa: Individuals who have established a successful business in the UK may become eligible for ILR after 3 to 5 years, depending on the business’s growth and job creation.
  • Tier-1 – Investor Visa: This visa is for individuals who want to invest at least £2 million in the UK. Under the Investor Visa route, you may qualify for ILR after 2, 3, or 5 years of residence, depending on the investment amount.
  • Ancestry Visa: Holders of an Ancestry Visa may become eligible for ILR after living and working in the UK for 5 years.
  • International Sportsperson Visa: You may be eligible for ILR after 5 years of continuous residence in the UK provided you meet all the requirements and if you’ve had visa issued at least once for longer than 12 months in previous 5 years.
  • Representative of Overseas Business Visa: After (initial 3 years + 2 years of extension) 5 years of stay on this visa you will be able to apply for settlement as long as you meet all necessary criteria.
  • Minister of Religion (T2) Visa: Upon completion of 5 years of stay in the UK and if you meet all necessary criteria, you may be able to apply for permanent residency / settlement visa for UK
  • Spouse or Partner or Family Visa: Those on a Spouse or Partner Visa or dependant Childre or Dependant parent of UK Citizens can apply for ILR after living in the UK for 5 years, demonstrating a genuine relationship and meeting financial criteria.
  • Long Residence Visa: Individuals residing continuously in the UK for 10 years may be eligible for ILR under the Long Residence category
  • Tier 2 (General) Work Visa: Individuals on this work visa may qualify for ILR after spending 5 years in the UK, provided they meet the necessary criteria, including continuous employment and income requirements.
  • Tier 2 (Intra-Company Transfer) Visa: Employees of MNCs who are being transferred to the UK to work for a UK branch of their company, after completing 5 years on this visa and subject to meeting all conditions, is eligible to apply for ILR Visa.
