About Turkish Businessperson Visa

  • The Turkish Businessperson Visa provides an opportunity for Turkish nationals to either establish a new business in the UK or to assist in running an already established enterprise. This visa, like the Turkish Worker Visa, is rooted in the ECAA, allowing Turkish entrepreneurs to thrive in the UK business environment. Despite the closure of new applications post-Brexit, current visa holders can still seek extensions or ILR.

Historical Context: The Ankara Agreement

  • The ECAA, commonly known as the Ankara Agreement, was established in 1973, allowing Turkish nationals to work or start a business in the UK. This agreement facilitated the path to permanent residence for Turkish citizens after a specified period.

Impact of Brexit on Turkish Visas

  • With the UK's departure from the EU on January 1, 2021, the immigration landscape for Turkish nationals changed significantly. The Turkish Worker and Businessperson visas were closed to new applicants as part of the post-Brexit immigration system overhaul. However, those already in the UK on these visas can still extend their stay or apply for permanent residency, ensuring continuity for existing residents.

Overview of the Turkish Businessperson Visa Extension

  • For those currently holding a Turkish Businessperson visa, it is possible to apply for an extension to continue your entrepreneurial endeavours in the UK. This visa allows you to continue running an existing business or start a new one. However, it’s important to note that new applications for this visa category are no longer accepted; only those already in the UK under this status can seek an extension. Additionally, children under 21 can still apply to join you as dependents.

What Are the Eligibility Requirements for Extending a Turkish Businessperson Visa?

  • To be eligible for a visa extension, you must already be in the UK on a valid Turkish Businessperson visa. You must also demonstrate that you have complied with all immigration laws. It is essential to show that your business remains operational and viable, that you can cover your share of the business costs, and that your business profits are sufficient to support you and your family without needing additional employment.
  • It is crucial to remain within the UK, Ireland, the Channel Islands, or the Isle of Man until a decision on your application is made, as traveling outside these areas will result in the withdrawal of your application.

What Documents Are Needed to Apply for a Visa Extension?

  • When applying for an extension, you need to provide a valid passport or another document that proves your identity and nationality. You must also show proof that you can support and house yourself and your dependents during your stay, which can include bank statements, payslips, and documents related to living costs. Additionally, you need to provide evidence of your business activities and finances, such as insurance documents, business accounts, HMRC documents, and proof of business premises.

How Long Can You Stay with an Extended Visa?

  • You can apply to extend your Turkish Businessperson visa for up to three years at a time. There is no limit to the number of extensions you can apply for, provided you continue to meet the eligibility requirements. After living in the UK for five years, you may be eligible to apply for Indefinite Leave to Remain (ILR), allowing you to live, work, and study in the UK indefinitely and apply for public benefits if eligible.

What is the Application Process for Extending Turkish Businessperson Visa?

  • AGCL Services can help you with rest of the visa process from completing the relevant visa applications forms to submit your application along with all the necessary and supporting documents.

How Long Does It Take to Get a Decision on Your Visa Extension?

  • Typically, you will receive a decision on your visa extension within six months of submitting your application. However, the process may take longer if additional verification of documents is required, if you need to attend an interview, or if there are complex personal circumstances involved.

Are There Any Fees for Extending Your Turkish Businessperson Visa?

There is no fee required to apply for a visa extension under the Turkish Businessperson category.

What Activities Are Permitted with a Visa Extension?

  • With a Turkish Businessperson visa extension, you can continue to run your business in the UK and start new ones. You can also continue to be a partner in an existing business, provided you have an active role in its operation. Additionally, you are allowed to study and undertake voluntary work. If you have lived in the UK for five years and meet other eligibility requirements, you can apply for Indefinite Leave to Remain (ILR).

What Are the Restrictions with a Visa Extension?

  • While holding a Turkish Businessperson visa, you cannot apply for most public benefits or the State Pension. You are also restricted from changing jobs or employers.

Expedited Decision on your Turkish Businessperson Visa Application

  • To expedite the decision on your visa extension, you can opt for priority or super priority services. The priority service allows you to receive a decision within five working days or within 30 working days for family visa applications from outside the UK. This service costs an additional £500. For an even faster decision, the super priority service is available for an additional £1,000. With this service, you can usually expect a decision by the end of the next working day following your appointment, or within two working days if the appointment is on a weekend or bank holiday. However, it is important to note that processing times can be extended if further information is required from you or if your details need to be checked with other government departments.

Extending Turkish Businessperson’s Dependants (Spouse and Children) Visa

  • If your partner and children are already in the UK as your dependents, they must apply separately to extend their visas. If your children or your partner’s children are joining you from outside the UK, they will also need to apply as your dependents.

ILR - Turkish Business Person Visa

Understanding Indefinite Leave to Remain for Turkish Businessperson

What is Indefinite Leave to Remain (ILR)?

  • Indefinite Leave to Remain (ILR), often referred to as settlement, grants individuals the ability to live, work, and study in the UK without any time constraints. Securing ILR means you can stay in the UK permanently, with the opportunity to apply for British citizenship. Additionally, it allows eligibility for public benefits. If you are a Turkish Worker or Businessperson, your family members, including your partner and children, can also apply for ILR if they meet the necessary eligibility criteria.

Fees and Processing Time for ILR Applications

  • Applying for ILR incurs a fee of £2,885 per applicant, which includes biometric data collection such as fingerprints and photographs. If your partner needs to extend their visa, the fee is £1,048, along with the healthcare surcharge. Typically, a decision on your application will be made within six months. However, this timeframe may be extended if further document verification, an interview, or consideration of complex personal circumstances like a criminal record is required.
  • It is important not to travel outside the UK, Ireland, the Channel Islands, or the Isle of Man during the application process, as this will result in the withdrawal of your application.

What Are the Eligibility Criteria for ILR for Turkish Businessperson?

  • To be eligible for Indefinite Leave to Remain in the UK, you must fulfil several requirements. Proficiency in the English language and passing the Life in the UK test are essential. Additionally, you must have lived and worked in the UK for the past five years without relying on public funds and should not have spent more than 180 days outside the UK in any 12-month period during these five years. If you are on a Turkish Businessperson visa, you must continue to actively operate your business.

Documents required for ILR Application

  • When applying for ILR, you need to provide a current passport or another valid travel identification. If your current passport does not demonstrate your legal residency in the UK for the past five years, you must provide previous passports as evidence. Additionally, you need to present the unique reference code proving you passed the English language requirement.

Specific Requirements for Turkish Businesspersons

  • As a Turkish Businessperson applying for ILR, you must show that you are actively managing a business. This can be evidenced through invoices, business bank statements, proof of National Insurance contributions if applicable, advertising materials, and documentation of renting or owning business premises.

Applying for ILR as a Family Member

Can Family Members of Turkish Businessperson Visa Holder Apply for ILR?

  • Your family members, including your partner and children, can apply for ILR if they meet specific criteria. Your partner must have been granted leave as your dependent and must have lived in the UK with you continuously for five years. They also need to meet the language and Life in the UK test requirements.

What Documents Do Family Members Need?

  • Each family member applying for ILR must provide a current passport or other valid travel identification and two passport-sized colour photographs. Additionally, proof of your relationship, such as a marriage or birth certificate, and evidence that they will live with you permanently, such as letters from your child’s school or doctor, are required. If you are the sole parent, you need to provide proof of sole responsibility for children under 21 through written permission or relevant legal documents.

How Can Children Qualify for ILR?

Children can apply for ILR if they have been granted leave as your dependents and apply simultaneously with both parents, or if both parents are already settled. They must not be married, in a civil partnership, have formed an independent family unit, or be leading an independent life. Children aged 18 or older must meet the language and Life in the UK test requirements.

How Does ILR Benefit Turkish Workers Visa Holders?

  • Once your application for Indefinite Leave to Remain is approved, you gain several rights and privileges. You can work, run a business, study, and use public services such as healthcare and schools. Additionally, you can apply for public funds (benefits) and pensions. After holding ILR for a minimum of 12 months, you may be eligible to apply for British citizenship.
